A US mother is on trial for murder after allegedly leaving her one-year-old son to die in a hot car. Maya Hernandez, 20, from California, was reportedly undergoing a cosmetic lip filler procedure when the tragicincident involving Amillio Gutierrez occurred. It is claimed she left them in the car for two hours and when Hernandez left the clinic and returned to her car, which was parked outside, she found her youngest child unresponsive and foaming at the mouth. Amillio’s body temperature was said to have reached a fatal 107°F (41.6°C). According to the outlet, witnesses claimed Hernandez rushed back into the spa holding her ‘limp’ and ‘purple’ baby. A different witness reportedly removed Mateo from the scorching car, while a nurse at the clinic said the toddler ‘looked like he was going to have a stroke.’ Mateo was also found to have had a dangerously high internal temperature — 99°F (37.2°C). Hernandez appeared in court on Monday, December 8, where it was revealed she is facing charges of second-degree murder and manslaughter, as well as two counts of child cruelty. Prosecutor Stephanie Taconi stated that Hernandez ‘chose vanity’ over the safety of her children. Taconi said: ‘[Hernandez] chose to leave them in the car. She chose a break. She chose time to herself. She chose time to socialize with other adults. And again, that choice cost Amillio his life.’ (Picture: Facebook)
During the hearing, the court heard that a nurse had spoken to the police about the event. It was reported that Hernandez had asked if it was possible to bring her children to the appointment with her. However, she allegedly never mentioned that she had the kids in the car with her at the time. It was also heard that the staff offered to let the children sit inside the clinic with the air conditioning. Hernandez allegedly decided to leave them outside instead. (Picture: Court TV)
The prosecution added: ‘There are no accidents here. There are no accidents in this case. This isn’t a case of a forgotten child whose mom was in a hurry. These were intentional actions, done wilfully by the defendant.’ Defense attorney Teryl Wakeman called the case ‘incredibly sad,’ and claimed that Hernandez didn’t commit murder, but instead, made a ‘terrible, awful mistake.’ The attorney also told the court that Hernandez ‘left her kids in their car seats with cookies, a bottle of milk, each, and with [her older son] she left her phone so that he could watch TV’. ‘The car was running, the air conditioning was on. Ms. Hernandez thought that the car would stay running, that the air condition would, likewise, remain on,’ he added.
